TEACHERS ON STRIKE

  • The CHR Office’s proposal of mediation in the strike of teachers. (more)
  • The hasty modifications in the organization process of school examinations, introduced in connection with the strike of teachers, may undermine citizens’ rights. The Commissioner has written to Minister Anna Zalewska with regard to his doubts concerning two regulations of the MInistry of National Education, dated 2 April 2019. (more)

EDUCATION

  • Some students of the Polish Air Force School in Dęblin are discriminated in the area of access to the education offer, says the CHR. Recruitment to air force practical training is different for students admitted in the first admission round than for students admitted in the later admission rounds. (more)
  • The Ministry of Education does not react to the homophobic statement of the Małopolska region’s education inspector. (more)
  • Parents complain that preschools do not admit children with food allergies or other chronic diseases. This has raised the CHR’s serious doubts as to the fulfilment of children’s rights provided for in the Constitution we well as the right to education. (more)

LIFE AND HEALTH

  • Mr Marcin died of a heart attack after ten hours of waiting in the emergency ward of the hospital in Wodzisław Śląski. The Commissioner has requested information on the case from the head of the district public healthcare centre and the District Prosecutor’s Office in Wodzisław Śląski. (more)
  • What should be the rules of conducting toxicology tests for persons deprived of liberty? (more)
  • People’s complaints and media information indicate that the poor condition of psychiatric care for children and youth can pose a risk to the patients’ health. The CHR has written to the Minister OF Health with regard to the issue. (more)

SYSTEM OF JUSTICE

  • The Supreme Court annulled the judgment of the military court which, in January 1945, sentenced a soldier of the Farmers’ Battalions to death. The cassation appeal was filed by the Commissioner who stated that the judgment was issued in gross violation of the then-binding law. (more)
  • On 10 April, the Constitutional Tribunal was to issue a decision on the compliance with the Constitution of unjustified refusal to provide service. In connection with the motion of the CHR to exclude Jarosław Wyrembak from the judicial panel, the Tribunal postposed the decision and excluded judge Wyrembak from the panel. (more)
  • The Commissioner’s opinion on the activities aimed at the annulment of Ewa Ivanova’s obligation to maintain secrecy as a journalist. (more)
  • The prosecutor exceeds his powers by challenging the Supreme Administrative Court's judgment regarding a birth certificate of a child born in a partnership of two women. The Commissioner has requested the court to dismiss the prosecutor's complaint as unfounded. (more)

FREEDOM OF ASSEMBLY

  • The decision of the mayor of Gniezno prohibiting to hold the equality parade on 13 April 2019 is unacceptable in the light of the Constitution and the Law on Assemblies. The CHR joined the organizers’ complaint. (more). The mayor’s decision was annulled by the District Court (more) and the Appeal Court in Poznań maintained the annulment. (more)
  • The Police Commander-in-Chief has replied to the CHR’s report on assemblies. He stated that the disturbance of legal assemblies is an offence in teh case of which the police may intervene. (more)
  • After the CHR’s letter of intervention, the sector for football fans, surrounded by a fence, at the stadium in Daleszyce will be disassembled. (more)
  • Judges and other lawyers from Olsztyn took a photo of them in front of the court building, manifesting their support for judges in relation to whom disciplinary proceedings are pending or judges on whom disciplinary penalties have already been imposed. The police arrived to the place and checked identities of some persons standing in front of te court building. The CHR has requested the head of the city police in Olsztyn to explain the situation. TAXES AND FEES

  • The key rights of taxpayers, to be respected by revenue bodies, are laid down in the bill on the Charter on Taxpayer Rights, which is currently subject to legislative work. (more)
  • In Tarnów, parking fees charged for cars towed because of parking on prohibited places are calculated per started parking day, even if the car is within the car park for only several minutes. The system has been challenged by the CHR before the administrative court. (more)
  • The CHR is seeking the observance of the rights of victims of the so-called wild restitution of property, who were evicted from their apartments. (more)

PERSONAL DATA

The Commissioner receives people’s complaints concerning personal data processing by churches and religious associations. The CHR has written to the minister of Digitization with regard to the issue. (more)

POLES ABROAD

Additional consular consultations, more people employed, employees delegated to work in the UK: these steps have been taken by the Ministry of Foreign Affairs in connection with the increased interest, of persons who live in the UK, in Polish passports, in the light of the upcoming Brexit. (more)

CONTRACTS

Building project investors draw up contracts so as to make it impossible for architects to exercise their property rights to original building plans they draw up. Architects indicate that these rights are non-transferable. The CHR supports separate regulations on the protection of integrity of architectural works, so as to safeguard the interests of both architects and investors. (more)
