Supporting students with disabilities – CHR report. Response from the Minister of Education

The Commissioner for Human Rights has been monitoring the implementation of the Convention on the Rights of Persons with Disabilities since 6 September 2012. In this respect, the Commissioner also analyses the situation of students with special educational needs and their parents in the context of the implementation of the right to inclusive education. The Convention guarantees the right to education for persons with disabilities and obliges public authorities to introduce an inclusive education system that allows for integration at all levels.

As part of independent research on discrimination in 2022, the CHR carried out a social survey entitled 'Accessibility of education for students with disabilities in the context of co-teaching, teaching assistance and personal assistant support'. The aim was to determine the extent of support needed by students with special educational needs to ensure the effective realisation of their right to education and to identify difficulties and barriers. The result is recommendations aimed at developing solutions for the activation of assistant support for pupils with special educational needs in kindergartens and schools, taking into account the provisions of the Convention.

By sending the report, the CHR hopes that the data, conclusions and recommendations from the report will be interesting and useful and will faciliate action to improve the situation of students with special educational needs in order to realise their right to education to the fullest extent possible.
