Poland's migration strategy for 2025-2030. Questions from the CHR to the Prime Minister - response from the Ministry of Interior and Administration
On 15 October 2024, the Council of Ministers adopted the document „Reclaim control. Ensure security. - Poland's comprehensive and responsible migration strategy for 2025-2030”.
Upon examination, CHR Marcin Wiącek asks the Prime Minister to clarify the following preliminary doubts regarding the assumptions of the strategy:
How does the government intend to implement the announced possible “temporary and territorial suspension of the right to apply for asylum” on the territory of the Republic of Poland, taking into account the norms of the Polish Constitution and Poland's international legal obligations?
How should the phrase “asylum application” be understood in this context: does it apply only to domestic protection, or does it also include applications for international protection?
The reply by Maciej Duszczyk, Undersecretary of State in the Ministry of Interior and Administration, points out that one of the proposed solutions is to introduce the possibility of temporarily and territorially suspending the right to receive asylum applications, i.e. applications by foreigners for international protection in Poland, in the event of a real threat of destabilisation of the state due to an influx of immigrants. Another proposal is to involve the Office of the Commissioner for Human Rights in the process of monitoring proceedings pending in the area in question.
