Poland has still not ratified the Optional Protocol to the Convention on the Rights of the Child. The impossibility of submitting individual complaints to the international control body authorised to respond to violations of the Convention - such as the Committee on the Rights of the Child - prevents the full exercise of the rights guaranteed by this international agreement. 

The Commissioner has repeatedly emphasized the need for a mechanism to ensure the effective enforcement of the Convention. Such a mechanism is the procedure for submitting complaints to the Committee on the Rights of the Child, as outlined in the Protocol. Marcin Wiącek once again addresses the Minister of Family, Labour and Social Policy regarding the ratification of the Protocol.

Agnieszka Dziemianowicz-Bąk, Minister of Family, Labour and Social Policy replied that the Ministry of Family, Labour and Social Policy has undertaken, in cooperation with other relevant ministries, analytical work aimed at determining the consequences of ratifying the Complaints Protocol to the Convention on the Rights of the Child. These works include, in particular, gathering information about the subject of complaints that could be submitted, in which violations of the convention by Poland would be raised. The result of these works will be the basis for making a decision on the further course of action.
