Application to the Polish Constitutional Tribunal - Polish Act on Railway Transport
The Human Rights Defender submitted an application to the Polish Constitutional Tribunal to declare the provision of Polish Act on Railway Transport unconstitutional. It was revealed in the cases investigated by the Human Rights Defender that there is a problem with stations, platforms and railway rolling stock adaptation to the needs of persons with disability and reduced mobility. The alarming state of infrastructure in this regard is, among other things, caused by unclear regulations. This is because the legislator has not determined the time horizon for fulfilling the obligation to modernise these devices and to guarantee that persons with disabilities have equal access to passenger railway transport. However, according to the Human Rights Defender this obligation is imposed on official authorities both by the constitution and by the UN Convention on the Rights of Persons with Disabilities which was ratified by Poland this year.
